1. Introduction

Welcome to MedianResourceCircle ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at medianresourcecircle.sbs (the "Service") operated by MedianResourceCircle.

By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Service Overview

MedianResourceCircle offers exclusive yacht charter services, which include but are not limited to:

• Daily yacht rentals
• Sunset cruises
• Corporate retreats
• Private events
• Multi-day charters

All services are subject to availability and weather conditions. We reserve the right to modify or discontinue services at any time.

3. Booking and Reservations

3.1 Booking Process

To reserve a charter, you must:

• Be at least 18 years old
• Provide truthful and complete details
• Pay the required deposit as indicated in your booking confirmation
• Accept these Terms & Conditions

3.2 Confirmation

Your reservation is confirmed only after payment is received and our written confirmation has been issued. We reserve the right to refuse service to anyone at our discretion.

3.3 Availability

All charters depend on vessel availability and appropriate weather conditions. We will exert reasonable efforts to accommodate your preferred dates and times.

4. Payment Terms

4.1 Pricing

All costs are quoted in € and already include taxes unless stated otherwise. Prices are subject to change without prior notice.

4.2 Payment Schedule

• Deposit: 50% of total charter cost payable at the time of booking
• Balance: Payable 48 hours before the charter sets sail
• Additional expenses (if any): Due upon the charter's conclusion

4.3 Payment Methods

We accept major credit cards, bank transfers, and certified cheques. Payment processing is managed through secure, encrypted platforms.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• With more than 72 hours notice before departure: Full repayment minus processing charges
• Between 24 and 72 hours prior to departure: 50% repayment
• Less than 24 hours prior to departure: No repayment

5.2 Weather Cancellations

If our captain deems weather conditions unsafe, we will propose to:

• Reschedule your charter to another suitable date at no extra charge
• Issue a full repayment if rescheduling isn't feasible

5.3 Mechanical Issues

Should your allocated yacht experience mechanical issues, we will endeavour to supply an appropriate substitute. If no replacement is obtainable, a complete refund will be issued.

6. Safety and Conduct

6.1 Safety Requirements

All guests are expected to:

• Heed all instructions from the crew
• Utilize safety gear when necessary
• Disclose any medical conditions that could affect their safety
• Stay within designated areas on the yacht

6.2 Prohibited Items

The following are not permitted on board:

• Glass containers
• Illegal substances
• Firearms or weapons
• Excessive beverages (beyond reasonable consumption)
• Pets (unless pre-approved)

6.3 Conduct

Guests are required to behave in a considerate manner. We retain the right to end a charter prematurely without reimbursement if a guest's conduct is a safety hazard or disrupts the experience of others.

7. Liability and Insurance

7.1 Our Liability

We limit our liability to the amount paid for your charter. We are not accountable for:

• Personal injuries arising from a guest's own negligence
• The loss or damage of personal items
• Indirect, consequential, or punitive losses
• Delays due to weather or situations we cannot control

7.2 Insurance Coverage

We hold complete marine insurance for our vessels and operations. Passengers are advised to secure their own travel and personal insurance coverage.

7.3 Assumption of Risk

By engaging in our yacht charters, you recognize that maritime activities carry intrinsic dangers and you take on liability for your personal safety and security.

8. Modifications and Itinerary Changes

We maintain the right to adjust itineraries, pathways, or timetables in response to conditions such as weather, safety, or operational needs. Efforts will be made to provide experiences of similar value.

9. Force Majeure

We shall not be held accountable for delays, cancellations, or alterations brought on by situations out of our control, which include but are not limited to:

• Severe weather events
• Natural disasters
• Governmental regulations
• Port shutdowns
• Vessel malfunctions

10. Privacy and Data Protection

Your private data is managed according to our Privacy Policy. By utilizing our services, you consent to the compilation and application of your data as outlined in the Privacy Policy.

11. Intellectual Property

All materials on our website, including but not limited to text, visuals, trademarks, and pictures, are secured by copyright and trademark laws. You are prohibited from reproducing, distributing, or creating derivative forms without our explicit authorization.

12. Governing Law

The provisions of these Terms are under the jurisdiction of the laws of Monaco. Disagreements will be settled in the courts within Monaco, Monaco.

13. Changes to Terms

We hold the authority to amend these Terms at our discretion. Revisions will be published on our website with a revised date of effect. Your continued utilization of our services constitutes agreement to the updated terms.
